Contrary to popular belief, notaries do not notarize documents, they notarize signatures. They are required to do the following:.

Examine Document

Examine the document for completeness.

Notarial certificate

Check the notarial certificate  to be in compliance with state law, if there is one preprinted. Identify the document signer.

Confirm Signers

Confirm the signers’ capacity to understand the document: Notaries can witness signatures even if they are not familiar with the language on the document. However, they must be able to communicate with the signer.

Oath/Affirmation

Administer the Oath/Affirmation or take the Acknowledgment.

Complete the Notarial Certificate by updating the venue if necessary, dating, confirming correct spelling of the signer(s), my signature, and imprint Notary seal.

Notarial Act

Sometimes the notarial wording is not found on the document you need notarized.  Such examples might be handwritten or private documents.  When this happens, the signer should ask the receiving agency – what type of notarization they need. The signer may also seek advice from an attorney or choose the act themselves.  Signer then instructs the Notary to add either an acknowledgement which proves you signed the document or a Jurat where the signer swears/affirms what they signed is true.

A notary who is not an attorney cannot decide what type of notarial act a document requires for that would be “practicing law.” The customer must know and tell the notary.

ID Requirements

The State of Texas requires notaries to verify the identification of every signer. Only valid, non-expired identification, with a photograph is acceptable. These Guidelines are set by the State of Texas, and can be found on the Secretary of State’s website, and are not at the discretion of your Notary.  Also, see https://www.dps.texas.gov/internetforms/getForm.ashx?id=DL-17.pdf

If a signer cannot provide acceptable form(s) of identification, then a witness can be provided, by the signer, who can vouch for the identity of the signer.  The witness MUST be able to provide one or more forms of valid identification to prove their identity, and must be able to vouch for the identity of the signer, under Oath.

In Texas, a credible witness must either personally know the Notary or must present to the Notary a valid, unexpired ID issued by the Federal or a State government that contains the photo and signature of the witness (1 TAC 87.40[2] and 87.1[1]).

A credible witness must know the signer well enough to be able to swear or affirm the signer’s identity before the Notary.
